Art. 2: SwissRide is a Swiss company offering transport services bookable via its platform. The driver is an independent partner, responsible for their professional obligations.
Art. 3: The contract allows the partner to access the platform to offer their transport services to SwissRide clients.
Art. 4: SwissRide facilitates the connection between the client and the partner through its platform, without being a party to the transport contract.
Art. 5: Open-ended contract. Either party may terminate with 30 days’ written notice.
Art. 6: SwissRide retains 30% of the net fare. The partner receives 70% via bank transfer or TWINT before the 10th of the following month.
Art. 7: The partner must create an online account, provide professional documents, and accept these terms and conditions.
Art. 8: Clients make a request via the platform. The partner may accept or decline. Once accepted, the ride becomes contractual.
Art. 9: SwissRide ensures platform access, manages payments, provides support, and notifies of any changes.
Art. 10: Partner obligations: vehicle compliance, punctuality, appearance, attitude, local regulations, insurance, hygiene, and client communication.
Art. 11: Monthly payment of the net amount due, after commission and any penalties. Payment methods: card, transfer, TWINT.
Art. 12: Right to cancel up to 24h before departure. Swiss consumer protection and data law apply.
Art. 13: SwissRide is not liable for the driver’s services or delays caused by external circumstances.
Art. 14: Clients can post public reviews on the platform. The partner agrees to their publication.
Art. 15: Partner ranking is based on various criteria (price, service quality, availability, reviews).
Art. 16: A commercial relationship between independents. No subordination.
Art. 17: SwissRide may terminate the contract without notice in case of serious breach.
Art. 18: Disputes or requests must be sent via the platform or email.
Art. 19: The partner agrees not to disclose any information related to clients or SwissRide.
Art. 20: This contract supersedes all prior agreements between the parties.
Art. 21: Swiss law applies. Disputes fall under the jurisdiction of Lausanne courts.
Art. 22: The parties may use mediation services before legal proceedings.
Art. 23: Data processing in compliance with Swiss data protection law. The partner must ensure data protection obligations.
Art. 24: SwissRide is committed to protecting partner personal data.
Art. 25: All official communications shall be made by email or via the platform.
Art. 26: SwissRide may amend these conditions with reasonable notice. The French version prevails in case of translation dispute.
